Terms of Service
1. Acceptance of Terms
By downloading, installing, or using Suisse Wallet (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
These Terms constitute a legally binding agreement between you ("User," "you") and Suisse Wallet ("we," "us," or "our").
2. Description of Service
Suisse Wallet is a non-custodial cryptocurrency wallet application that enables users to:
- Generate and securely store cryptographic private keys on their own device
- Send, receive, and manage digital assets across supported blockchain networks
- Interact with decentralised applications (dApps) and smart contracts
- Convert between supported cryptocurrencies via integrated swap functionality
- Make QR-code-based payments at participating merchants
Suisse Wallet does not act as a bank, financial institution, broker, exchange, custodian, or fiduciary. We do not hold, control, or have access to your digital assets at any time.
3. Eligibility
By using the Service, you represent and warrant that:
- You are at least 18 years of age (or the age of legal majority in your jurisdiction)
- You have the legal capacity to enter into binding agreements
- Your use of the Service complies with all applicable laws and regulations in your jurisdiction
- You are not located in, or a citizen or resident of, any jurisdiction where use of cryptocurrency wallets is prohibited
4. User Responsibilities
You are solely and exclusively responsible for:
- Safeguarding your seed (recovery) phrase and private keys — Suisse Wallet cannot recover them
- All transactions initiated from your wallet, including verifying recipient addresses and amounts before confirmation
- Maintaining the security of your device and preventing unauthorised access
- Compliance with all applicable tax reporting and payment obligations
- Compliance with all applicable sanctions, anti-money-laundering, and export-control laws
Important: Loss of your recovery phrase will result in permanent and irreversible loss of access to your digital assets. Suisse Wallet has no ability to restore access.
5. Assumption of Risk
You acknowledge and accept that the use of digital assets and blockchain technology involves significant risks, including but not limited to:
- Extreme market volatility and potential loss of value
- Smart-contract bugs, vulnerabilities, or exploits
- Regulatory uncertainty and evolving legal frameworks
- Cybersecurity threats, including phishing, malware, and social engineering
- Irreversibility of blockchain transactions — once confirmed, transactions cannot be undone
- Network congestion, high gas fees, or temporary unavailability of blockchain networks
You assume all risks associated with using the Service and interacting with blockchain networks.
6. No Financial or Legal Advice
Nothing in the Service or on our website constitutes investment, financial, tax, or legal advice. You should consult qualified professionals before making financial decisions.
7. Third-Party Services and dApps
The Service may allow you to interact with third-party decentralised applications, blockchain networks, token contracts, and other services not operated by Suisse Wallet. We do not control, endorse, or assume any responsibility for such third-party services. You interact with them entirely at your own risk.
8. Intellectual Property
All content, design, code, trademarks, and other intellectual property associated with Suisse Wallet are owned by or licensed to us. You may not copy, modify, distribute, or create derivative works based on our intellectual property without prior written permission.
9. Prohibited Uses
You agree not to use the Service to:
- Engage in any activity that violates applicable laws or regulations
- Facilitate money laundering, terrorist financing, or sanctions evasion
- Distribute malware, viruses, or any harmful code
- Interfere with or disrupt the operation of the Service
- Attempt to gain unauthorised access to other users' wallets or data
- Misrepresent your identity or affiliation
10. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory.
To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy, reliability, or completeness of any information
- Uninterrupted or error-free operation
11. Limitation of Liability
To the maximum extent permitted by applicable law, Suisse Wallet, its directors, employees, agents, and affiliates shall not be liable for:
- Loss of digital assets or cryptocurrencies
- Loss of profits, revenue, data, or business opportunities
- Indirect, incidental, special, consequential, or punitive damages
- Unauthorised access to or alteration of your wallet
- Any damages arising from third-party services or dApps
In no event shall our total aggregate liability exceed CHF 100 (one hundred Swiss francs).
12. Indemnification
You agree to indemnify, defend, and hold harmless Suisse Wallet and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your violation of any third-party rights
13. Termination
We may suspend or discontinue the Service (or any part of it) at any time, with or without notice, if required by law or to prevent abuse. Since Suisse Wallet is non-custodial, discontinuation of the Service does not affect your ability to access your digital assets using your private keys or recovery phrase through compatible software.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the substantive laws of Switzerland, without regard to its conflict-of-law provisions.
Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of the Canton of Zurich, Switzerland.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Suisse Wallet with respect to the Service.
17. Changes to These Terms
We reserve the right to modify these Terms at any time. The "Last updated" date at the top of this page indicates when the latest revision was made. We will make reasonable efforts to notify users of material changes. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
